In Australia, if you don’t have a significant asset pool (family home, investments) and can agree on who gets what and work out parenting arrangements in a way that suits you both, it’s possible to finalise a relationship in a reasonably affordable manner.

Not everything has to be done immediately either, so if financial pressures are an issue, it’s okay to prioritise the order of matters to suit your situation. Even if the split is amicable, it’s still a great idea to get some legal advice because time limits do apply – and – without legally finalising your matter – your ex-partner may still be able to make a settlement claim.

If you need a divorce, you’ll need to pay the Federal Circuit & Family Court divorce application – $1060 or a reduced fee of $350.

If you have parenting or property matters, most people start with a Mediation session, which can start around $500 to upwards of $5,000 depending on who you work with and how long you book for. Rates will depend on the time taken, the location and the skills of your mediator.

Consent orders or financial orders to formalise parenting and property may need to be completed, which have application fees plus costs to come to an agreement (legal negotiations or mediation) and have them drawn up.

Legal advice and court representation can become costly for more complex or drawn-out matters, as you will pay an hourly or daily fee.
